At LM Riders LLC (“we,” “us,” “our”), we specialize in the safe and efficient delivery of shipping containers to residential, commercial, and industrial locations. This Shipping Policy outlines our delivery processes, your responsibilities as the customer, timeframes, fees, and the protocols for damage, delays, and failed deliveries. By placing an order with us, you acknowledge that you have read, understood, and agreed to the terms outlined below.
1. Delivery Areas
We currently offer delivery services within the following regions:

2. Delivery Timeframes & Scheduling

Important Notes Regarding Timeframes:
All delivery windows are estimates only and are not guaranteed. Weather, traffic, mechanical breakdowns, and carrier availability can cause delays.
We will contact you at least 48 hours in advance to confirm a specific delivery date and 2-hour time window.
You must be available to receive the delivery during the scheduled window. If you are not present, the delivery will be aborted, and you will be responsible for a re-delivery fee.
3. Delivery Methods & Equipment

Your Responsibility: You must inform us at the time of order if your delivery site has any unique access challenges (e.g., narrow roads, overhead wires, low-hanging trees, soft ground, or gated communities). Failure to disclose these conditions may result in an aborted delivery and additional fees.
4. Your Responsibilities for Delivery
To ensure a successful drop-off, you (the Customer) agree to the following:

| Ground Conditions | The drop-off surface must be firm, level, and dry. Soft ground, sand, mud, or steep slopes may prevent the truck from safely offloading the container. We reserve the right to refuse delivery if the ground is deemed unsafe by the driver. |
| Access Roads | The road leading to your property must be able to support the weight of a heavy-haul truck (up to 80,000 lbs fully loaded). We are not responsible for damage to driveways, asphalt, or landscaping caused by the weight or turning radius of the delivery vehicle. |
| Obstacles | You must remove or clearly mark any obstacles, including parked vehicles, gates, fences, low-hanging branches, or construction debris. |
| Permits | You are solely responsible for obtaining any necessary municipal permits, HOA approvals, or right-of-way permits required for placing a shipping container on your property or for the delivery truck to access your street. |
| Authorized Receiver | A responsible adult (18 years or older) must be present on the day of delivery to sign the Bill of Lading (delivery receipt) and inspect the container. The driver cannot legally leave the container without a signature. |
Failure to meet any of these requirements will result in an aborted delivery, and you will be responsible for the full delivery fee and a re-delivery charge.
5. Inspection at Delivery (Crucial Step)
This is your only opportunity to inspect the container before legal acceptance.
The delivery driver is required to wait while you perform a visual inspection. We strongly recommend you:
Walk around the entire container.
Open and close both doors to ensure they function properly.
Check for major structural damage (e.g., large dents, holes, severe corrosion, or floor rot) that was not disclosed in your pre-sale condition report.
Verify the container size (e.g., 20ft or 40ft) and grade match your order.
If you are unsatisfied or the container does not match the ordered grade:
You MUST refuse delivery at the time of drop-off.
Clearly write your reason for refusal on the Bill of Lading.

If you sign the Bill of Lading without noting any exceptions:
The container is legally deemed accepted “as-is” in its delivered condition.
We will not accept claims for cosmetic damage, minor dents, surface rust, or door alignment issues discovered after the driver has departed.
6. Delivery Fees & Payment

| Toll / Permit Surcharges | Any tolls, bridge fees, or oversize/overweight permit fees incurred during transit will be passed through to the Customer and added to the final invoice. |
| Re-Delivery Fee | If a delivery is aborted due to lack of access, no one present, unsafe ground, or failure to clear obstacles, you will be charged a re-delivery fee of [e.g., $150 – $350] (depending on distance) to reschedule and attempt delivery again. |
Payment: All delivery fees must be paid in full before the container is dispatched from our yard. We do not offer “Cash on Delivery” (COD) for shipping.
7. Failed, Aborted, or Missed Deliveries
A delivery is considered “failed” or “aborted” under the following circumstances:

| You refuse delivery at the time of drop-off. | You are responsible for the outbound delivery fee. A refund for the container price (minus deposit and delivery costs) will be processed if the refusal is due to our error (e.g., wrong grade). If the refusal is for any other reason (change of mind), the deposit is forfeited. |
| You cancel the order after the container has been dispatched. | There are no refunds for shipping fees. The container will be returned to our yard, and you are responsible for both the outbound and return freight charges. |
| Severe weather or road closures. | We will reschedule the delivery at no additional cost to you as soon as conditions are safe. This is not grounds for a refund. |
8. Damage During Transit
Title and Risk of Loss: As stated in our Terms and Conditions, risk of loss, damage, or theft passes to you the moment the container is loaded onto the delivery truck at our yard (FOB Origin).
Carrier Responsibility: We use licensed, insured, and professional heavy-haul carriers. If the container is damaged during transit, we will assist you in filing a claim against the carrier’s insurance.
Your Duty: You must:
Note the damage clearly on the Bill of Lading at delivery.
Take dated photos of the damage before the driver leaves.
Contact us within 24 hours of delivery to initiate the claim process.
Limitation: If you sign a “clean” Bill of Lading without noting damage, the carrier is released from liability, and we cannot assist in filing a claim.
9. Storage Fees
If your order is delayed due to your actions (e.g., you are not ready to receive the container, payment is not cleared, or you request us to hold the container beyond the agreed delivery date), the following storage fees apply:
Storage Fee: $25.00 per day, per container, assessed starting on the 3rd business day after the container is ready and scheduled for delivery.
Accrual: Storage fees accrue daily and must be paid in full before the container is released or delivered.
10. Tracking & Communication
Order Confirmation: You will receive an order confirmation email immediately after placing your order.
Delivery Notification: You will receive a notification via email or phone call within 24 hours of your container being dispatched.
Day-of Delivery: The driver will call you approximately 30 to 60 minutes before arriving to confirm your presence at the site.
Tracking: We do not offer real-time GPS tracking for container deliveries. However, we will provide you with the carrier’s contact information if you wish to coordinate directly.
11. Export Shipping (Port Delivery)
For customers purchasing containers for export:
We deliver to the port or rail yard of your choice (e.g., Port of Houston, Port of Savannah).
You are responsible for:
All port fees, wharfage, and demurrage charges.
Customs clearance, export documentation, and ISF filings.
Arranging the crane or equipment to offload the container from our trailer at the port (if required).
We will hold the container at our yard until we have received written confirmation from your freight forwarder that the port is ready to receive the unit.
12. Force Majeure (Unavoidable Delays)
We shall not be held liable for delays or failure to perform delivery due to causes beyond our reasonable control. This includes, but is not limited to:
Acts of God (hurricanes, floods, tornadoes, earthquakes).
Severe weather or road conditions.
War, terrorism, or civil unrest.
Strikes or labor disputes (port closures, trucker strikes).
Government regulations, road closures, or permit denials.
Mechanical breakdowns or equipment failures.
Supply chain disruptions beyond our control.
In the event of a force majeure delay, we will notify you as soon as possible and reschedule delivery at no additional cost to you. No refunds will be issued for force majeure delays.
